“Everyone has a duty to compensate for losses they have caused through their acts or failure to act” as prescribed by Article 1779 of the Civil Law of the Republic of Latvia. So, if a person causes damage to the property of a third party or damage to health/life of a third party, she or he has a duty to compensate for the caused losses in full. Civil liability insurance for legal entities allows you to protect your financial interests from the above-mentioned liability. It means that the Insurer will compensate for losses unconsciously caused by an employee of the Insured person to third parties. Sometimes the caused damage is quire significant. If there is no insurance policy it may cause serious financial problems for a merchant. Therefore the purpose of the civil liability insurance is to protect the Insured from possible losses. What is being insured?

BTA, in accordance with the provisions of an insurance contract, pays the following indemnities to third parties:

  1. for losses as regards injured party: medical treatment, temporary disability, disability or death.
  2. for losses as regards direct damages or loss of the third party property;
  3. for litigation expenses;
  4. for rescue expenses.

In order for a third party to receive an insurance indemnity, there must be four generally accepted conditions:

  1. unlawful activity (activity or inactivity) of any person,
  2. offence of this person;
  3. Existence of losses and certain amount thereof,
  4. causal relationship between unlawful activity and losses.

What insurance can you acquire in addition?

Insurance protection is prepared individually for each Insurance Policy Holder, wherewith the Insurance Policy Holder may narrow it down, providing for that only certain type of losses and certain amount of losses are to be compensated, or expanding it, selecting various offered insurance protection expansions, for example:

  1. civil liability for damages caused to the surrounding nature and environment,
  2. liability for the provided services,

What is a third party?

Any individual or legal entity, except for the ones specified in the policy (the Insurance Policy Holder, Insured and the Insurer).

What is liability amount?

It is the maximum amount BTA pays to a third party in the insurable event. The liability amount is set upon agreement of the parties (if it is not set forth in regulatory enactments of the Republic of Latvia).

What is the insurance period?

Usually the validity period of an insurance contract is one year; however, it is possible to draw up an insurance contract for a shorter period when it is necessary.

An insurance contract may be drawn up:

  1. for one year for the entire commercial activity insured;
  2. for a particular period, for implementation of one project/contract.

How is an insurance policy drawn up?

  1. Receiving initial information: in order to enter into an insurance contract, you have to fill in respective insurance application form.
  2. Offer preparation: based on the information provided in the insurance application, BTA experts will submit you an insurance offer, explain terms and condition and answer to your questions.
  3. Policy issuance: when you agree with the BTA offer, an insurance policy is prepared.

How to receive an insurance indemnity?

  1. upon agreement with BTA, you have to take all possible measures in order to prevent or reduce the incurred or possible losses;
  2. BTA must be informed in due time of any claim or action brought against you as regards losses caused to third parties;
  3. as soon as it is possible you have to inform BTA of any event that could be the grounds for claims brought against you regarding compensation for losses;
  4. documents related to insurance claim must be submitted to BTA.

How the compensation for losses is carried out?

Within 30 days after receiving all required documents BTA will take a decision regarding compensation for losses; you and the injured party will be informed of such decision within 10 days. The Insurer pays the insurance indemnity to a third party within 15 (fifteen) working days counting from the day the decision regarding paying the insurance indemnity is taken.
